1. Acceptance of Terms
By downloading, accessing, or using the EDS Mobile application ("App") or our eSIM mobile services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.
2. Description of Services
EDS Mobile provides mobile telecommunications services through eSIM technology via our proprietary mobile application. Our Services include but are not limited to:
- Mobile data plans and connectivity
- eSIM activation and management
- Account management through our App
- Customer support services
2.1. Access To Emergency Services or E911
You acknowledge and agree that the App and Services do not support or carry emergency calls to any type of hospitals, law enforcement agencies, medical care units, or any other kind of emergency services (collectively, "Emergency Services") or E911 Directly Through The EDS Mobile App. However you can reach 911 at any time using your phones native dialer.
By using the App, you acknowledge and agree that:
- EDS Mobile is not required to offer access to Emergency Services under any applicable local and/or national rules, regulations, or law.
- It is your responsibility to purchase reliable mobile or landline telephone services that offer access to Emergency Services.
- You must use your device's native dialer and underlying cellular carrier to place emergency calls.
- EDS Mobile LLC is not liable for any inability to access Emergency Services through the App or for any interference with your ability to place emergency calls using your device's native dialer.
3. Eligibility
You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
4. Account Registration
To use our Services, you must create an account and provide accurate, current, and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
5. eSIM Activation and Compatibility
- You are responsible for ensuring your device is eSIM-compatible and unlocked
- eSIM activation requires a stable internet connection
- Not all devices support eSIM technology; compatibility is your responsibility to verify
- Once activated, eSIM profiles are tied to your specific device
6. Service Plans and Billing
Payment Terms:
- All fees are charged in advance unless otherwise specified
- You authorize us to charge your chosen payment method for all fees
- Automatic renewal may apply unless you cancel before the renewal date
- All sales are final unless otherwise required by law
Changes to Pricing:
- We reserve the right to modify our pricing with 30 days' notice
- Continued use of Services after price changes constitutes acceptance
Refund Policy:
- Refunds are handled on a case-by-case basis
- Unused data may not be refunded unless required by applicable law
Messaging and Data Rates:
When you use the App to send messages or make calls, standard data usage rates from your mobile carrier may apply. Furthermore, if the Service interacts with standard SMS/MMS networks, "Message and Data Rates May Apply" depending on your carrier plan and the recipient's carrier plan. You are solely responsible for any such charges associated with your use of the App.
7. Acceptable Use Policy
You agree NOT to use our Services to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Transmit harmful, threatening, abusive, or offensive content
- Distribute spam, malware, or viruses
- Engage in fraudulent activities
- Interfere with or disrupt our Services or servers
- Attempt unauthorized access to our systems
- Resell or redistribute our Services without authorization
- Use automated systems to access the Services without permission
- Engage in "robocalling," "spamming," or sending unsolicited bulk messages in violation of the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, or other applicable anti-spam laws
- Use the Services for auto-dialing, predictive dialing, or any other method of sending messages or making calls without the prior express consent of the recipients
- Interfere with or disrupt the integrity or performance of the Services or the data contained therein, including by overloading the system (e.g., "flooding" or "mailbombing")
8. Service Availability and Coverage
- Services depend on network availability and coverage in your area
- We do not guarantee uninterrupted or error-free service
- Service quality may vary based on location, network conditions, and device
- We reserve the right to modify, suspend, or discontinue Services at any time
- Scheduled maintenance may temporarily interrupt Services
9. Data Usage and Fair Use
- Data limits apply according to your selected plan
- Excessive usage beyond fair use policies may result in speed throttling
- We reserve the right to suspend accounts engaging in abusive data usage
10. Intellectual Property
All content, features, functionality, trademarks, service marks, and logos in our App and Services are owned by EDS Mobile and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any portion of our Services without written permission.
11. Privacy
Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.
12. Third-Party Services
Our App may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third parties.
13. Termination
By You:
- You may terminate your account at any time through the App or by contacting support
- Termination does not entitle you to refunds for unused services
By Us:
- We may suspend or terminate your account if you violate these Terms
- We may terminate Services with notice for business reasons
- Upon termination, your right to use the Services immediately ceases
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- EDS Mobile is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
- We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
- We are not liable for indirect, incidental, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
15. Indemnification
You agree to indemnify, defend, and hold harmless EDS Mobile and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of Services or violation of these Terms.
16. Dispute Resolution
Governing Law: These Terms are governed by applicable laws, without regard to conflict of law provisions.
Arbitration: Any disputes arising from these Terms or Services shall be resolved through binding arbitration, except where prohibited by law.
17. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via the App or email. Continued use of Services after changes constitutes acceptance of the modified Terms.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
